Policies at Photo Lesk

IT IS IMPORTANT YOU READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE BOOKING & USING OUR SERVICES AND ON-LINE SHOP:

 

• All Deposits paid are non- refundable.

• All paid services are non - refundable

• All vouchers/gift cards are valid for 1 year (12 calendar months) from purchase . All vouchers are non transferable ,Non refundable. Cannot be exchanged for cash. Photo Lesk reserves the right to modify the terms at any point in time and without notice.

• You must present your voucher at the time of the photoshoot (printable version or on your phone so that the code and barcode are visible to scan). Photoshoots cannot and will not be redeemed without it.

• If your voucher doesn’t have a date on it, it is already out of date and therefore invalid.

• Covid 19 - It is understood that any curtesy extension of expiry date for gift cards due to covid lockdowns (if so decided by photo lesk) are at the discretion of photo lesk entirely. Photo lesk reserves the right to modify this at any point in time and without notice. It is also understood that in case of any restrictions of max amount of people from either us or the gov, will not be considered for any extension of expiry time of voucher (meaning if photoshoots are able to take place , even with restrictions , then no extension shall be made and or considered).

• If you have a valid voucher before COVID and shop closure : All valid vouchers at time of closure of the shop & studio (first lockdown 16 March, 2020) will be extended by 5 months , valid voucher valid at 2nd lockdown are extended by 1 month .Please note that any restrictions of max amount of people from either us or the gov will not be considered for any extension of expiry time of voucher (meaning if photoshoots are able to take place , even with restrictions , then no extension shall be made ).

Release & Use of images:

Images supplied by a photographer are protected by the Copyright, Designs and Patents Act 1988 and other legislation, and a breach of copyright law is a SERIOUS OFFENCE. 

By receiving any images supplied by Photo Lesk, you acknowledge your acceptance of the terms of this Licence and you agree to be bound by its terms and conditions. 

Any failure to comply with the terms of this Licence may be dealt with as a copyright infringement.

All Images supplied by Photo Lesk are licensed and are supplied by any means (CD, DVD, USB Stick, Email, Download, etc’) with ‘High Resolution’ ("Print") and ‘Low Resolution’ ("Web") formats.

Photo Lesk will supply you with a non-exclusive, non-transferable, licence to use the supplied Images, only after all payment have been settled and in the following ways:

From the High Resolution images you may make an unlimited number of prints for ‘Personal use’ (As defined below) only. They are NOT to be used for public display on websites or any such medium.

The Low Resolution Images have been resized to be suitable for most online websites and may be used for ‘Personal use’ (As defined below) and public display on websites or any such medium. Please note that these images are not suitable for printing.

 

For the purposes of the Licence Agreement and Terms & Conditions ‘Personal use’ does not include use that which results in financial gain (Including but not limited to: advertising, stock photography, print sale profits, or resale of any nature). It also excludes use for other commercial or editorial purposes, as well as competition use without the express written permission of PhotoLesk.

It is not permitted to alter or adjust any of the ‘High’ or ‘Low’ Resolution images without the express written permission of Photo Lesk.

The above permissions apply worldwide.

​

Your purchase and acceptance of the images files (Supplied to you by means of DVD, CD, USB Stick etc’) releases Photo Lesk from any liability due to loss or damage of the images, and also releases Photo Lesk from any obligation to maintain copies of any digital file, image, or photograph.

By accepting, paying and receiving your services you hereby grant Photo Lesk the right to use and publish images and photographs taken at your photography session, to further promote its service, including portfolio, web site, display, advertisement, and editorial use. 

Photo Lesk agrees to limit the use of these images and photographs to promotional use only.

All right, title and interest in the Licensed Images, including (Without limitation), all copyright, patent, trademark, rights of publicity and other proprietary rights, are owned and shall remain with Photo Lesk.

Commercial Use of Photos:

Commercial or any non-domestic use of images will be based on a commercial release which may be different for each assignment and may incur additional costs. 

By accepting any images, you are agreeing to the above Terms & Conditions.

This Licence Agreement is governed by English law and shall fall under the Exclusive Jurisdiction of the Courts of England and Wales.

Booking a Photoshoot & Deposits:

All personal photoshoot packages will be booked after a non-refundable deposit is made. Photo lesk reserves the right to modify the amount of deposit per circumstance , and without notice

• You can reschedule your booking up to 24 hours prior to your appointment in advance otherwise you will be charged for a new deposit in order to rebook (Gift Vouchers included) and any deposits will not be refunded.

• ‘No-shows’ will also be charged full price of photoshoot in case they wish to re-book - nor refunds will be given for any amount paid for a no show!

• On location photoshoots will be charged on booking and cancelation in due time will be given a refund minus £50 deposit paid.

• On location photoshoots - the client is responsible to make sure the venue they choose to be photographed is allowing such activity to take place. Photo Lesk will not be held responsible for any illegal or unauthorised photography activity in any venue the client chooses and its the sole responsibility of the client to make sure no laws are broken and full permission is given by the venue owner and/or operator.

Passport Photos - no refunds. If there is a fault and the photo is rejected by a UK official government body, we will offer you to remake the photo for free if it is reasonable to do so.

Commercial Photoshoots- 50% non refundable deposit required to book and save.

Remainder of payment to be made once editing is completed and BEFORE release of photos to client. Photo Lesk will not release any photos should payment not be made in full.

Wedding Photography:

Wedding bookings (please view separate wedding T’s & C’s -contract which will be supplied to you once booked) - a non refundable 10% deposit is required in order to book and save the date.

Full payment is to be made in advance and up to 4 weeks prior to the day. Otherwise it be seen as termination of contract by the client and Photo Lesk will be released of any commitment and is not required to save the date.

No refund shall be made on deposits.

Photography Course:

In order to secure your place in a course , we require a non-refundable £50 deposit booking fee on the day of booking. In case there are not sufficient students to open a course, you will be able to book a place for the next one.

Printing General:

By using our services you ensure and accept you do not :

• infringe anyone’s copyright; in particular, you must ensure that you either own the copyright of an Image you upload/ send for order to Photo Lesk or that you are fully licensed by the copyright owner to upload/order/send the Image and to make any subsequent use of it (such as by including the Image in a product or in email )

• infringe anyone’s privacy or data protection rights; in particular, you must ensure you have the right to depict any person who appears in an Image that you upload/send to Photo Lesk and to authorise the subsequent use of it (such as by including a depiction of that person in a Product or in email and any communications we send to you);

• infringe any other rights, such as a trade mark, of any person or entity or a duty owed to any person or entity, such as a duty of confidentiality;

• contravene any applicable law (including, without limitation, any criminal law) or regulation;

• include anything that is false, inaccurate, misleading, offensive, abusive, threatening or defamatory, or that might cause needless annoyance, inconvenience or distress to any person;

contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information

By using our online shop you also agree that once you upload a photo and send the order though it enters our production workflow and cannot be changed. Any change after this will be chargeable. Thus, it is your responsibility to make sure the photo/file is of sufficient quality as advised on our website per size, and you accept full responsibility for the quality of photo you choose to send/print
